Abuse of Algorithmic Rights: The Boundary of Criminal Liability for AI Manipulation in the Securities Market

Abstract: With the deepening application of AI in securities markets, the issue of abuse of power in algorithmic trading has become prominent, posing a threat to market fairness and investor rights. This paper focuses on the challenges in identifying criminal liability for algorithmic market manipulation and explores the scope of liability for AI decision-making entities under the current legal framework. Existing research primarily revolves around algorithmic transparency, determination of subjective intent, and assessment of market impact, but a consensus has not yet been formed regarding liability attribution for autonomous algorithmic decision-making. The "black box" nature of intelligent algorithms challenges the determination of traditional criminal law subjective elements, while novel manipulation methods expose regulatory lags. Significant differences in management across jurisdictions reflect conflicts between technological ethics and legal values. Current research lacks targeted liability theories, suffers from insufficient interdisciplinary integration, and has a scarcity of empirical samples. The future requires the construction of a criminal liability framework adapted to the characteristics of algorithms, improving diversified regulatory models, providing legal theoretical support for balancing technological innovation and market order, and contributing to the improvement of China's securities market regulatory system. The Dilemmas and Improvement Paths of Civil Protection of Personal Information in the Context of Data and Platform Compliance

Abstract: From the perspective of data compliance and platform governance, this paper adopts empirical research and normative analysis to conduct a systematic study on the civil protection of personal information in China. An examination of current institutional practices reveals prominent dilemmas in key areas such as legislative coordination, judicial application, platform liability enforcement, and individual rights remedies. These dilemmas mainly include insufficient adaptability of legal rules, unbalanced allocation of the burden of proof, ineffective implementation of platform compliance, and high costs for individual rights relief. Based on China’s existing legal framework and judicial practice, this paper proposes a systematic improvement path for the civil protection of personal information from five aspects: refining legislation, unifying adjudication standards, improving platform internal control mechanisms, optimizing remedy channels, and establishing a multi-stakeholder collaborative regulatory system. This can provide practical reference for the protection of personal information civil rights and the standardized operation of platforms. This article only focuses on the analysis of civil remedies and does not delve into the mechanism of civil execution connection. The empirical materials mainly consist of public judgments made by some courts, which restricts the research scope to a certain extent. In the future, we can combine new application scenarios such as algorithm recommendation and cross-border data transmission to further improve the rules for civil compensation and liability determination, promote the collaborative efforts of multiple governance mechanisms, and achieve a dynamic balance between personal information protection and platform compliance in the context of sustainable development of the digital economy. Making Technology More Intelligent: Seeking the "Local Characteristics" of Digital Rural Governance

Abstract: Digital rural governance is the cornerstone of modernizing national governance, therefore exploring digital rural governance has become an important topic. The "locality" of digital countryside refers to the need to pay attention to the uniqueness of rural society, and to break through a single operating mode in the interaction between modern and traditional. As an efficient governance tool, digital technology can help rural development, but it cannot be limited to universal linear processes. It should be embedded in the natural environment, social status, and core needs of rural areas, and closely integrate technology with the characteristics and practices of rural areas. Only then can technology truly empower rural areas. On the premise of respecting the development laws of different types of rural areas, a basic path for the "locality" of digital rural areas is constructed through typical cases to promote the modernization process of digital rural governance. Comparison of Elderly Care Models between China and the United States and the Development Path of China's Silver Economy

Abstract: This paper discusses the inherent differences in the elderly care systems for older adults in China and the United States, based on how each country structures its pension system, cultural values, and service models. It points out that the existing elderly care mode in China has problems including the unbalanced development of a multi-level security system and an uneven allocation of resources between different areas and between urban and rural regions. To promote high-quality development of the Silver Economy in China, it is imperative to exert more effort at the level of system design, industrial extension, technology innovation, and active measures in the coming stage. In particular, drawing on cases such as the Hainan Free Trade Port, this article further explores the possibility that policy innovation and industrial integration may provide a new pattern for the high-quality and international development of the local elder care industry. Research on the Controversy and Optimization Path of Rent Pricing Mechanism for Public Rental Housing: A Policy Analysis based on the Background of Concentrated Market Entry in Multiple Regions in 2025

Abstract: With the continuous advancement of urbanization in China, the housing pressure on new urban residents and young people has become prominent. The supply of public rental housing has entered a concentrated phase, and the rental pricing mechanism has sparked debates on fairness and sustainability. This paper focuses on the core issue: how to ensure the affordability of tenants while achieving sustainable operation of the project and addressing the conflicts of interests among multiple stakeholders. By using the methods of literature analysis and policy text comparison, and combining social justice, welfare pluralism and ecosystem theory to construct a three-dimensional analytical framework, this paper analyzes the structural contradictions in the current pricing mechanism. The research finds that rental governance needs to go beyond the administrative price limit thinking, establish a dynamic model of "benchmark rent + floating coefficient", promote the collaborative governance of the government, market, society and tenants, and introduce social workers to participate in demand assessment, rights advocacy and community mediation to enhance the inclusiveness and resilience of the system. The limitation lies in the lack of support from field interview data. In the future, qualitative research can be deepened by combining the practice of front-line social workers. Read More

Research on the Internal Mechanism and Practical Path of Enterprise Talent Policy Innovation from the Perspective of Human Capital Governance

Abstract: In the context of the knowledge economy, talent is the most important asset of enterprises. In this situation, traditional methods of managing talent are difficult to fully utilize the advantages of human capital. How to effectively innovate talent policies in enterprises is a problem from management to governance. Therefore, this article will analyze the relevant issues of talent policy innovation in enterprises from the perspective of human capital governance. This study indicates that human capital governance emphasizes the property rights attributes, incentive compatibility, risk sharing, and value co creation of human capital as the logical starting point for talent policy innovation. Based on this, enterprise talent policy innovation plays the role of three internal mechanisms: the equity allocation mechanism of property rights incentives, the collaborative empowerment mechanism of value co creation, and the psychological contract mechanism of relationship contracts. Specifically, in practice, enterprises should take top-level design, institutional design, cultural construction, and technological support as the methodological basis for effectively carrying out talent policy innovation, and develop a series of talent policy innovation plans based on this. The article has enlightening significance for grasping the basic principles of innovation in enterprise talent policies and has reference value for enterprises to improve their talent management mechanisms. Embedded Absorption: The Institutionalization Logic of Urban Community Governance Communities

Abstract: The institutionalization of urban community governance communities is key to unlocking fragmented grassroots governance and activating residents' endogenous motivation for participation. While there has been ample policy discourse and diverse practices concerning the construction of urban community governance communities, the internal “institutionalization” mechanism remains a theoretical “black box” that has yet to be fully unpacked. This study argues that “embedded absorption” effectively addresses challenges such as fragmented actors, structural rigidity, and unsustainable actions in community governance through mutual shaping and coordination across three dimensions: actors, structures, and actions. The research reveals that the essence of governance communities lies in the reproduction of social relations, and their institutionalization pathway illustrates a form of creative integration between the state and society within the field of grassroots governance. Digital Leviathan: Digital Convenience and Digital Domination in the Information Age

Abstract: Big data technology is a pivotal scientific and technological achievement of the information age. Its integration with state political power and market capital has given shape to the digital Leviathan. From the theoretical perspective of dialectics of nature, this paper argues that big data technology has driven a paradigm shift in humanity’s understanding of the world, fostering acceptance of the ambiguity of data and emphasis on the correlations between data. Meanwhile, big data technology has enhanced humanity’s ability to transform the world, empowering traditional government governance and market industries, and driving improvements in governance efficiency and productivity through technological innovation. However, big data technology has undergone alienation while empowering political power and market capital, forming the digital Leviathan. Through the coercive power of state authority and the developmental momentum of the market economy, it has become an instrument of domination over humanity, resulting in infringements on the rights of individual members of society.
